1. Overview

These Terms of Service (“Terms”) govern your use of try-homely.com and any purchase made from the Homely store, operated by ROUKY LLC (“we”, “us”, “our”). By visiting the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority in your state of residence, to place an order. By ordering, you confirm that the information you provide is accurate and complete.

3. Products and pricing

We describe and display our products as accurately as possible. Colors may vary slightly depending on your screen. All prices are shown in U.S. dollars (USD) and may change at any time without notice. Prices do not include applicable sales taxes, which are calculated at checkout.

We reserve the right to limit quantities, refuse or cancel any order, including in case of a pricing or description error, suspected fraud, or product unavailability. If your order is canceled after payment, you will receive a full refund.

4. Orders and payment

Your order is confirmed once payment has been authorized and you receive an order confirmation email. Payments are processed securely by our payment providers; we do not store your full card details.

5. Shipping

Shipping times and conditions are described in our Shipping Policy, which forms part of these Terms. Risk of loss passes to you upon delivery to the carrier’s stated delivery address.

6. 40-night trial, returns and refunds

Returns and refunds are governed by our Refund Policy, including our 40-night free returns guarantee, which forms part of these Terms.

7. Use of the Site

You agree not to use the Site for any unlawful purpose, to interfere with its operation, to attempt to gain unauthorized access to it, or to copy or exploit its content without our written permission.

8. Intellectual property

All content on the Site, including text, images, logos and product names, belongs to ROUKY LLC or its licensors. No license is granted to you other than to view the Site for personal, non-commercial use.

9. Disclaimer of warranties

Except as expressly stated in these Terms or required by law, the Site and products are provided “as is” and “as available”, without warranties of any kind, express or implied, including implied warranties of merchantability and fitness for a particular purpose.

10. Limitation of liability

To the fullest extent permitted by law, ROUKY LLC shall not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or products. Our total liability for any claim relating to an order shall not exceed the amount you paid for that order. Nothing in these Terms limits any rights you may have under applicable consumer protection laws.

11. Indemnification

You agree to indemnify and hold harmless ROUKY LLC and its members from any claim arising from your breach of these Terms or misuse of the Site.

12. Governing law and disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of law rules. Before starting any formal proceedings, you agree to contact us first so we can try to resolve the issue informally. Any dispute that cannot be resolved informally shall be brought before the competent state or federal courts located in Wyoming, unless applicable law gives you the right to bring a claim in your state of residence.

We may update these Terms from time to time. The version in effect at the time of your order applies to that order.
